Terms of Service | Mhauz

Welcome to Mhauz. By accessing or using the Mhauz platform (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully. If you do not agree, do not use the Platform.

1. What Mhauz Is

Mhauz is a peer-to-peer listing platform that enables private sellers to list BMW M vehicles for sale and enables buyers to browse and contact sellers. Mhauz is not a dealer, broker, or party to any transaction. We do not take title to any vehicle, hold funds in connection with any sale, or guarantee the accuracy of any listing. All transactions are between buyers and sellers directly.

2. Eligibility

You must be at least 18 years old and legally authorized to enter into contracts in your jurisdiction to use the Platform. By creating an account, you represent that you meet these requirements.

3. Account Registration

You are responsible for maintaining the security of your account credentials. You must provide accurate, current information. You may not create an account on behalf of another person without their authorization. Mhauz reserves the right to suspend or terminate accounts that violate these Terms.

4. Seller Responsibilities

By listing a vehicle on Mhauz, you represent and warrant that:

You are the legal owner of the vehicle or are authorized to sell it
All information in your listing is accurate and not misleading
The vehicle has the title status disclosed in the listing
You will respond to buyer inquiries in good faith
You will comply with all applicable laws governing vehicle sales in your jurisdiction
You will not list vehicles that are stolen, under active lien without disclosure, or subject to a recall that renders them unsafe to operate

Only genuine BMW M vehicles are permitted on the Platform. M Performance models (M340i, M440i, etc.) and non-M BMW vehicles are not eligible for listing.

5. Buyer Responsibilities

Buyers are solely responsible for evaluating any vehicle before purchase, including conducting independent inspections, verifying the title, and confirming the vehicle's condition. Mhauz provides VIN decode and title history information as a convenience only — this information is not a guarantee of a vehicle's condition, history, or title status. Never wire money or transfer funds without physically inspecting the vehicle and verifying the title in person.

6. Fees

Listing a vehicle on the Free tier is at no cost to sellers. Featured and Spotlight listing tiers carry a one-time fee as described on the Pricing page. Optional promotion add-ons carry fees as described. A buyer's premium of 4.5% (minimum $250, maximum $3,500) is added to the transaction total when payment is processed through the Platform.

7. Prohibited Content and Conduct

You may not use the Platform to:

Post false, misleading, or fraudulent listings
Harass, threaten, or abuse other users
Circumvent the Platform to avoid fees (e.g., directing buyers off-platform before a listing sale is completed)
Use automated tools to scrape, crawl, or harvest data
Impersonate another person or entity
Engage in any unlawful activity

8. Identity Verification

Featured and Spotlight tier sellers are required to complete identity verification through our third-party provider (Stripe Identity). Providing false identification is a material breach of these Terms and may be reported to law enforcement.

9. Intellectual Property

By uploading photos or other content to the Platform, you grant Mhauz a non-exclusive, royalty-free, worldwide license to display that content in connection with operating the Platform. You retain ownership of your content. You represent that you have the right to upload any content you submit.

10. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MHAUZ DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. MHAUZ MAKES NO WARRANTY REGARDING THE ACCURACY OF ANY LISTING, THE IDENTITY OF ANY USER, OR THE QUALITY, SAFETY, OR LEGALITY OF ANY VEHICLE LISTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MHAUZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSSES ARISING FROM TRANSACTIONS BETWEEN BUYERS AND SELLERS. MHAUZ'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE FEES YOU PAID TO MHAUZ IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Mhauz and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your listings, or your violation of these Terms.

13. Dispute Resolution

Any disputes between buyers and sellers are the sole responsibility of the parties involved. While Mhauz may provide a dispute inbox to facilitate communication, Mhauz is not obligated to mediate or resolve any dispute. You agree to attempt to resolve any dispute with Mhauz directly by contacting us at legal@mhauz.com before initiating any legal proceeding.

14. Modifications

Mhauz reserves the right to modify these Terms at any time. We will notify registered users of material changes via email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
